Copyright & Takedown Policy

Overview
Muse Collectivity ("we", "us", "our") respects the intellectual property rights of creators and expects all users of Muse Collectivity to do the same. This policy outlines how we handle copyright on our platform in accordance with the Copyright Act 1968 (Cth), including the safe harbour provisions under Part V Division 2AA, and international copyright standards.
If you believe that content on Muse Collectivity infringes your copyright, or if your content has been removed in error, this page explains your options.
Our Role as a Service Provider
Muse Collectivity operates as an online service provider that hosts and facilitates the sharing of user-generated content. We do not review, approve, or curate content before it is uploaded. We rely on our users to ensure that the content they upload does not infringe the intellectual property rights of others.
We have adopted and implemented this policy in accordance with the safe harbour provisions of the Copyright Act 1968 (Cth), which provide certain protections to service providers who act expeditiously to remove or disable access to infringing content upon becoming aware of it.
User Content Ownership
When you upload music, audio files, artwork, or other creative content to Muse Collectivity, you retain full ownership of your original work. We do not claim ownership of any content you create or upload.
By uploading content, you represent and warrant that:
- You are the original creator of the content, or you have obtained all necessary rights, licences, and permissions to upload and share it
- Your content does not infringe the copyright, trademark, or other intellectual property rights of any third party
- You have the right to grant the licence described below
Licence Granted to Muse Collectivity
By uploading content to the platform, you grant Muse Collectivity a non-exclusive, worldwide, royalty-free licence to:
- Host and store your content on our servers and through our service providers
- Display and stream your content to other users as part of your profile, portfolio, or project workspace
- Reproduce your content as necessary for technical operations (such as creating thumbnails, generating waveforms, or encoding audio for streaming)
- Promote your content on the platform and in marketing materials (for example, featuring a portfolio track on the Muse Collectivity homepage), unless you opt out of promotional features
This licence exists solely to allow us to operate the platform. It does not give us the right to sell your content, sub-licence it for commercial use beyond platform operations, or claim creative ownership. This licence terminates when you delete the content or close your account, except where the content has been delivered to another user as part of a completed project.

Reporting Copyright Infringement
If you believe that content on Muse Collectivity infringes your copyright, you may submit a takedown notice. To be processed, your notice must include all of the following:
- Your contact details: Your full legal name, email address, and mailing address (or your authorised agent's details if someone is acting on your behalf).
- Identification of the copyrighted work: A clear description of the copyrighted work you claim has been infringed. Include links to the original work where possible (for example, a Spotify, SoundCloud, or personal website link).
- Identification of the infringing content: The specific URL(s) or location(s) on Muse Collectivity where the infringing content can be found.
- Statement of good faith: A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- Statement of accuracy: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on behalf of the copyright owner.
- Your signature: A physical or electronic signature (typing your full legal name is sufficient).

We aim to review and respond to all valid takedown notices within 5 business days. If the notice is valid, we will expeditiously remove or disable access to the infringing content and notify the user who uploaded it.
Counter-Notification Process
If your content has been removed due to a copyright takedown notice and you believe the removal was made in error or that you have authorisation to use the content, you may submit a counter-notification. Your counter-notification must include:
- Your contact details: Your full legal name, email address, and mailing address.
- Identification of the removed content: A description of the content that was removed and where it appeared on Muse Collectivity before removal.
- Statement of good faith: A statement, made under penalty of perjury, that you have a good-faith belief that the content was removed as a result of mistake or misidentification.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Australian courts and that you will accept service of process from the party who submitted the original takedown notice (or their agent).
- Your signature: A physical or electronic signature.
Send your counter-notification to: copyright@musecollectivity.com with subject line "Copyright Counter-Notification".
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not notify us within 10 business days that they have filed a court action seeking a restraining order against the user who posted the content, we may restore the removed content.
Repeat Infringer Policy
Muse Collectivity maintains and enforces a repeat infringer policy in accordance with the Copyright Act 1968 (Cth). This policy is a condition of the safe harbour protections available to us as an online service provider.
- First offence: The infringing content is removed and the user receives a formal warning via email explaining the infringement and the consequences of further violations.
- Second offence: The infringing content is removed and the user's account may be temporarily suspended while we review the situation. The user will be notified and given an opportunity to respond.
- Third offence: The user's account will be permanently terminated. Users who are terminated under this policy are not permitted to create new accounts.
We reserve the right to terminate accounts immediately in cases of egregious or wilful infringement, regardless of the number of prior offences. We also reserve the right to take action in fewer steps where the infringement is clearly intentional.
A record of copyright strikes is maintained for each user account. Strikes that have been successfully contested through the counter-notification process are removed from the user's record.
Content in Project Workspaces
Content shared within project workspaces (including deliverables, reference files, and chat attachments) is subject to the same copyright protections as all other content on the platform. If copyrighted material is shared without authorisation within a workspace, the affected party may submit a takedown notice using the process described above.
In the event of a copyright dispute related to a project deliverable where funds are held in escrow, the dispute will be handled through our standard dispute resolution process in conjunction with this copyright policy.
Misuse of the Takedown Process
Submitting a false or misleading takedown notice is a serious matter. If you knowingly make material misrepresentations in a takedown notice or counter-notification, you may be liable for damages, including costs and legal fees incurred by the affected party or by Muse Collectivity.
Please ensure that you have a genuine and good-faith belief of infringement before filing a notice. Abusing the takedown process to harass other users or gain a competitive advantage is a violation of our Terms of Service and may result in account suspension or termination.
